How to appeal my outcome
Asking for a review
You can ask for a review of your suspension or conditions at any time. A review is different to seeking a formal appeal.
You can seek a review if you believe a suspension, or conditions on your registration, shouldn’t apply anymore.
A review may not be an option if you already have an appeal against the decision that imposed the suspension or conditions under way in the NSW Civil and Administrative Tribunal (NCAT) or the Supreme Court
If the decision in your matter says you can’t ask for a review before a certain date, there will be a limit on when you can apply.
The first step in seeking a review is to write to the Council or your nominated contact person.
You should:
- outline the grounds and reasons for your request
- list any conditions you want reviewed and whether you want them removed or altered
- include any relevant documents.
The Council will tell you how your review application will be considered and who will conduct the review. It depends on the circumstances of your case.
When Councils review decisions, they consider whether the original decision is still appropriate and/or whether your circumstances have changed since it was made.
We’ll advise how you can participate and when you can expect a result. If you have any questions about the review process, you can contact us.
If you need advice about your individual circumstances, it’s best to ask your lawyer, insurer/indemnity organisation, or professional association.
Lodging an appeal to NCAT
An appeal is a formal request to change a previous decision or a part of that decision. You have the right to appeal your outcome and you must do that within 28 days of receiving the reasons for the decision.
The NCAT Occupational Division manages appeals against Council decisions.
You can contact NCAT with any questions. We recommend you seek legal advice before making an appeal. If you don’t succeed, you may have to pay our legal costs.
